Larry the Twitter bird is not a simple geometric shape, I don't see how this can be classified as public domain under that rationale. Kelapstick (talk) 01:44, 15 June 2012 (UTC)

Thats the new official logo and it's new name it's "twitter" not Larry as it was previously. Do NOT delete. — Preceding unsigned comment added by 70.45.161.212 (talk • contribs)
- Confirming that this is the new official Twitter logo means that this MUST be deleted from Commons, since it is property of Twitter and not an original free licensed work. -- Infrogmation (talk) 16:23, 17 June 2012 (UTC)
Deleted Seems a clear case by everyone looking at it from the copyright standpoint. While some logos (such as Twitter's simple letter "t") can fall under PD-text-logo, this bird design clearly does not. "Fair use" of copyrighted material is not allowed on Commons. -- Infrogmation (talk) 16:31, 17 June 2012 (UTC)
This stylized bird is a work of art. It is not merely geometric shapes, and thus can not be assumed to be in the public domain. LadyofShalott (talk) 03:30, 15 June 2012 (UTC)
- Delete I must have missed it when I listed File:Twitter 2010 logo.svg and File:Twitter 2012 logo.svg, but the same rationale applies. --Kelapstick (talk) 03:34, 15 June 2012 (UTC)

No verifiable source information and no authorship information to substantiate the claim that this photo is in the public domain. The uploader blanked out the {{No source since}} problem tag without addressing the problem. —LX (talk, contribs) 10:46, 15 June 2012 (UTC)
- The uploader added a Library of Congress source (and blanked out the tag pointing to this discussion in spite of its clear instruction not to do so). The source does not name an author to confirm the claim that the author died more than 70 years ago, and there is no date of publication (only creation) to otherwise establish public domain status. US works by unknown artists created in 1924 and published after 2002 are copyrighted through 2044. —LX (talk, contribs) 22:41, 16 June 2012 (UTC)
This photo has a corporate author (National Photo Company) and is more than 70 years old. The original dated negative is in the collection of the Library of Congress. The Library of Congress website also states that there are “no known restrictions on publication”. The website is Library of Congress

Is this really okay for {{PD-textlogo}}? While the text would be okay per se, what about the fairly elaborate background? Decltype (talk) 22:33, 26 March 2010 (UTC)
- Keep: The background is in shades of beige, with no distinguishable shape or form, such background isn't elaborate or eligible for any type of copyright. Xeworlebi (t•c) 12:36, 27 March 2010 (UTC)
Keep I agree with Xeworlebi, the shades of the background is nothing that copyright can be claimed for. -- Neozoon (talk) 22:15, 10 June 2010 (UTC)

This image is licensed claiming it "only consists of simple geometric shapes and/or text". This is inaccurate, as the background image and possibly the beveling should easily meet the threshold of originality. — pd_THOR | =/\= | 02:22, 24 July 2010 (UTC)
- Keep Same deletion rationale as above. --PaterMcFly (talk) 07:14, 24 July 2010 (UTC)
Kept. I'm closing this early. Unless there are new issues raised, we all have better things to do than debate the same image twice in five weeks. Jim . . . . Jameslwoodward (talk to me) 14:02, 24 July 2010 (UTC)
I must concur with previous DRs, this is not in any way PD-SIMPLE or PD-TEXTLOGO. The background is undeniably complex - if it were without text, we'd easily accept it was copyrighted. -mattbuck (Talk) 18:11, 15 June 2012 (UTC)
Delete Very complex. I think the previous DRs resulting in the file being kept won't change it. C3F2k (Questions, comments, complaints?) 18:15, 15 June 2012 (UTC)
- And it is also possible a court could rule this to be copyrightable because of the 3D letters and the background, and thus I think we need to delete the image per COM:PRP. C3F2k (Questions, comments, complaints?)
Delete As per my 2010 nomination, adding that it would be prudent to err on the side of caution in cases where reasonable doubt exists that an image meets {{PD-textlogo}}. decltype

It says that the "Picture should have been taken around 1936". German photos taken in 1926 or later are copyrighted in the United States, see COM:URAA. They may thus not be uploaded to Commons. Stefan4 (talk) 10:05, 15 June 2012 (UTC)
- Alright, just delete it. The reason I uploaded it in Commons was because the picture was originally a candidate from en.wikipedia to be moved to commons, so that it can be used in other wikipedia projects. The source, and the picture that is uploaded to commons by me is an exact of the one in en.wikipedia. But then as I checked the Josef_Mengele.jpg from en.wikipedia just now, the status is changed. I can see no more suggestion for it to be copied here. So it is up to you and the rest of the users to do the next appropriate action. I give my green light to delete it but then you can see much more tags in en.wikipedia regarding the same pictures Josef_Mengele.jpg. Maryline Anak Martine (talk) 05:07, 24 June 2012 (UTC)
- Note that English Wikipedia's requests about moving images to Commons often are applied automatically: if the file information page indicates a licence which is compatible with Commons, then the file is flagged for moving to Commons. However, the person moving the file still needs to verify that the licence claim is correct. --Stefan4 (talk) 17:27, 24 June 2012 (UTC)

- Keep. At least in this file doesn't appear any trademarked character (a snow-bunny isn't Bugs Bunny, the character is not recognisible) and the blackfaces here despicted neither looks really to Elmer Fudd or Bugs Bunny.--Coentor (talk) 11:40, 16 June 2012 (UTC)
- Keep. Hello to all. OK, everyone knows that the aforementioned image is PD. The main problem, as of the incomming mass deletion of PD images with well-known character in it, is that some character may be still (USA) copyrighted. Do look for Commons:Undeletion_requests#Falling_hare_bugs.jpg discussion : it ends up with deletion in accordance with this pdf [10]. According to it, AVELA made a copyright infringement using modified images for placement on retail products. Is this case apply to every image/file with a character in it ? I don't think so. Is somebody here a real established lawyer ? Mr Godwin from Wikimedia is, and believes that this kind of images should be OK. Yes, a warning that states something like "Don't make missuses of this file/image, according to the laws in USA" would be great on the relevant page.
- File:JAL Dream Express-vertical stabilizer jpg pixelated.png contains copyrighted logotypes (yes, the JAL and UNICEF ones !). I believe that anyone who extract one of them and claim this is his property will be prosecuted. Though, there is no warning or disclaimer laid on the page.
-
- Um, no, you are misunderstanding Commons:Undeletion requests#File:Falling hare bugs.jpg. The court concluded that using unmodified copies also violates the copyright, although there seemed to be some permission from Warner Brothers to use unmodified copies (at least for specific uses). However, this permission would at best grant a {{Nonderivative}} licence, and as you can see, the {{Nonderivative}} template is a speedy deletion template. I think that there was some lawsuit in Japan which says something about whether you may take photos of vehicles displaying copyrighted works, although I don't remember the outcome. You would have to refer to that lawsuit for the other image. --Stefan4 (talk) 12:51, 20 June 2012 (UTC)
Delete What the courts said is that all of the files listed in this DR are derivative works of more technically this screenshot, which marked the first appearance of Bugs Bunny. C3F2k (Questions, comments, complaints?) 02:07, 26 June 2012 (UTC)
- This File shouldn't de deleted, because not a single trademarked character appears on it.--Coentor (talk) 12:45, 19 August 2012 (UTC)
- Isn't that rabbit supposed to be Bugs Bunny? --Stefan4 (talk) 19:59, 19 August 2012 (UTC)
- Yes. The snow-rabbit in the film's title card is definitely intended to represent Bugs Bunny. - Seth Allen (discussion/contributions), Saturday, August 25, 2012, 17:20 UTC.
- I disagree. It can be intended to represent Bugs Bunny, or could be a similar character. Either, it can also just be a bunny-like snowman. I mean, it's just a Screenshot of a Snow Rabbit in a Bugs Bunny movie. It's not necessarily BB, as it's not refered to be BB in the whole cartoon.--Coentor (talk) 07:51, 27 August 2012 (UTC)

- Delete all, and then undelete the images in 2036 along with all of the other derivatives of the Bugs Bunny character that were previously deleted from Commons, which I have listed together in a single section at Category:Undelete in 2036. Their presence constitutes ambiguous violation of Warner Bros.' copyright on the Bugs Bunny character design. In any version —be it the Ben Hardaway-created prototype, the Tex Avery-created design from the rabbit's official debut films, or the final, commercially current design introduced by Robert McKimson— Bugs is still a copyrighted character himself, even though some of his early films (i.e., Fresh Hare, Falling Hare, and various others) have fallen into the public domain, and yet, even when his copyright does expire, trademark restrictions on the character will still apply, as long as he is commercially being used by Warners, whether as a mascot or otherwise. Taking all of that into account, I request that all of these images be deleted as soon as possible. - Seth Allen (discussion/contributions), Saturday, August 25, 2012, 17:20 UTC.
- Comment It would be a great mistake to delete ALL file! this, this and this one are completly free images because are screenshots taken from a PD movie with no registered characters on it.--Coentor (talk) 12:17, 27 August 2012 (UTC)

Files in Category:Tintin
editTinTin was first published in 1929, the author hasn't been dead for very long. Some of these are 3D derivatives of the artwork in the comic books. That still makes the pictures protected by copyright.

- About drawings from Wiener book (printed in 1880) there is no more copyright, as far as the pictures come from the original book I have at home. The point is Hergé made a "copyvio" of Wiener Book. So I cannot understand why this pictures, done by mys-self could be supposed to be under copyright. Deuxtroy (talk) 17:15, 15 June 2012 (UTC)
- I hardly speek any French, what do they have to do with Tintin? Did the author use them as source material? I'm confused :S --Vera (talk) 17:20, 15 June 2012 (UTC)
- Yes, that's the funny point, because Hergé'family is very hard with copyvio, but he used a lot of material without caring with copyright to draw Tintin's comic. A lot of drawings from this very old book are used in "Tintin - Le temple du Soleil" (De zonnetempel) and others. Sorry, I thought I had translate comments in english, but I am not very much experimented with commons editing rules. Yours. Deuxtroy (talk) 17:44, 15 June 2012 (UTC)

I fixt the image:Triumph herald 1961 060117.jpg. It is not a 3D- model of a Tintin image. It is a real car that is also used in the Tintin comic. --Walter (talk) 19:05, 15 June 2012 (UTC)

The rocket is a faithful replica of a real world rocket so going from real rocket to cartoon to model should perhaps not change it. // Liftarn (talk)

- Delete File:Fusée de Tintin.jpg ; I don't know about the copyright argument, but this image is unnecessary as it's very similar to File:FuseeLunaireTintinCentreBelgeBD-Bruxelles.JPG, which I think is better. - Keep. FOP laws do not apply here: it is not public space, it's a privately owned park with entrance fees. What's more, the park actively encourages visitors to take photographs and even promises that their employees will help and assist with taking pictures, eg. Blomsterpigerne er desuden behjælpelige, hvis tdu mangler hjælp til fotografering. [13]. tsca (talk) 10:05, 16 June 2012 (UTC)
- Copyright rarely covers just making photos, but distributing them. Without license, you may use this photo only for personal or fair use. Park owner's would probably be not happy if they see their photos advertising another enterprise without their permission. A.J. (talk) 16:48, 16 June 2012 (UTC)

- Why do you even persist? Again: your initial claim is invalid, FOP laws (§ 24 of the Danish Ophavsret) do not apply here, it is not a "work exhibited in a place accessible to the public". Just stop. tsca (talk) 15:49, 19 June 2012 (UTC)
- That's EXACTLY my claim. FOP laws does not apply here, so please tell what OTHER law ("I think is OK because they allow making photos" is not a law) permits redistribution and commercial usage. EOT. A.J. (talk) 13:30, 20 June 2012 (UTC)

- Copyright rarely covers just making photos, but distributing them. Without license, you may use this photo only for personal or fair use. Park owner's would probably be not happy if they see their photos advertising another enterprise without their permission. A.J. (talk) 16:48, 16 June 2012 (UTC)
Who is the sculptor of that work or is it a ready-made mass product? --Túrelio (talk) 08:45, 23 June 2012 (UTC)
Deleted: FOP is an exception to the general rule that an image of a copyrighted work will be a derivative work. The fact that FOP does not apply, means that this image infringes on the sculpture's copyright. Note to Turelio -- even mass produced sculptures have a copyright. Unless the frog is PD-old, this infringes. . Jim . . . . Jameslwoodward (talk to me) 17:11, 20 September 2012 (UTC)
Sorry, but this is obviously a modern work of art and located in Iceland, which has no usable freedom-of-panaroma exemption from copyright. Thereby, this image violates the copyright of the sculptor. -- Túrelio (talk) 20:39, 15 June 2012 (UTC)
I sent an e-mail to the artist and asked her what she thinks about the use of the picture of her artwork. I hope she will send an answer; then it should be clear whether the photo has to be deleted or not. -- DasPumm (talk) 16:46, 24 June 2012 (UTC)
Hallo Túrelio! Steinunn Thorarinsdottir, die Erschafferin des besagten Kunstwerkes, hat mir folgendes geschrieben: "Hello Stefan and thank you for your note. Your photo of Álög is great. Thank you very much for inserting it. So please know that I agree that your photo is published in Wikipedia."

I think PD-text logo applies here but I am not sure, the letter "A" is special Ezarateesteban 21:05, 15 June 2012 (UTC)

the uploader even claims it's his own work. C3F2k (Questions, comments, complaints?) 21:13, 15 June 2012 (UTC)
- No: Most of the users (specially newcomers) uses the CC license because is the default choice for most newcomers and not for bad faith. Assuming good faith with these files implies simply change the CC license with {{PD-textlogo}} or any other proper permissions tag. Amitie 10g (talk) 21:52, 15 June 2012 (UTC)
- Keep: The geometric forms in the A are too simple to meet the threshold of originality; {{PD-textlogo}} is the right permissions tag. Amitie 10g (talk) 21:52, 15 June 2012 (UTC)
Kept: Using a pair of dividers as an "A" is fairly common. . Jim . . . . Jameslwoodward (talk to me) 17:15, 20 September 2012 (UTC)
The artist died in 1945. These photographs are derivative works and infringe on the copyright belonging to his heirs. There is no evidence that we have any permission for these. Since he was French it is unlikely that any exception is available that will allow us to keep them unless we get permission from the heirs.
I have not included
which is a photograph of Printemps which may be PD. Jim . . . . Jameslwoodward (talk to me) 21:46, 15 June 2012 (UTC)
- [The following is a copy of an e-mail sent to Jameslwoodward by Cecil H]
- WIKIPEDIA may get tranquility of conscience by verifying that the uploaded images are PUBLICLY SHOWN on the OFFICIAL WEBSITE dedicated to Léon Printemps. The website, developed by someone else, shows the uploaded paintings including others that are not uploaded yet.
- Jacques Noireau, the owner of all those paintings, is the grandson of Léon Printemps. He, and I, understand WIKIPDIA's concern to avoid raising any copyright problem. Let me know if WIKIPEDIA needs a declaration in writing and how it can be provided, so that we can close this file.
- [ends]
- Unfortunately the fact that the images are publicly shown elsewhere on the Web means very little. There is a great deal of material on the Web that is not properly licensed. Since there is nothing about copyright, one way or the other, at http://leon-printemps.fr.nf/, we must assume that everything there is copyrighted.
- Assuming that M. Noireau is Printemps's sole heir and owns the copyrights (which is different from owning the paintings), please have him send a message to Commons using the procedure at Commons:OTRS giving us either a license for the paintings listed above or a license for all Léon Printemps paintings uploaded by you, past and future. The message should come from [email protected], which is the address given for M. Noireau on the official web site. That will allow us to keep the images on Commons.
- If you will tell me here or on my talk page after that message has been sent, then I can promptly deal with it and close this DR. Jim . . . . Jameslwoodward (talk to me) 15:10, 18 June 2012 (UTC)
