In Beca Carter Hollings & Ferner Ltd v Wellington City Council [2024] NZSC 117, the Supreme Court considered the relationship between the longstop provision in the Building Act 2004, which prevents claims relating to building work being brought more than 10 years after the act or omission, and the contribution regime. The majority of the Supreme Court accepted the Council's argument that the longstop provision was not intended to affect the right of defendants to claim contribution from joint tortfeasors. Our solicitors Michael Evans, Timu Wano, Beth Murfitt, and Shontelle Grimberg attended the 2024 Hui ā Tau (Annual Conference) for Te Hunga Rōia Māori o Aotearoa in Whakatāne at Te Whare Wānanga o Awanuiārangi last week. It provided a space for Māori lawyers, judges and tauira to come together to share their experiences, knowledge, and journeys with one another. The theme of this year's Hui ā Tau was gifted by Tā Hirini Moko Mead which was an extract from a waiata tohutohu (song of advice) composed be Te Kooti Arikirangi in 1884 and emphasised the importance of mana motuhake (self determination of Māori). There was a range of workstreams which included Ture Tauhokohoko (Commercial), Whenua/Te Taiao (Land and Environmental), Te Tiriti (Treaty), Whānau (Family), Taihara (Criminal). Many of the lectures, panel discussions, and workshops were delivered bilingually in both te reo Māori and te reo Pākehā. Russell McVeagh sponsored the keynote session "Tikanga and Te Tiriti in the Senior Courts" with Justice Whata, Justice Tahana and Justice Harvey. It was a very insightful and great session! The evening sessions included the annual tauira Kaupapa Māori Moot and Negotiation competitions, Te Matature inter-rohe kapa haka and the Conference Awards Dinner which were all great opportunities to appreciate the skills and talents of many in the hunga and whakawhanaungatanga over some delicious kai. It was a pleasure to sponsor and for our attendees to be a part of this event. We look forward to the 2025 conference!
